Plymouth District Court– The officer testified the client, who was driving a motorcycle crossed over the solid double yellow line into the opposite traffic lane and then drove less than one car length away from the car in front of him while crossing over the double yellow lines multiple times. The officer stated that when he turned on his emergency lights,the car in front of the client pulled over and the client passed this car and continued to drive.The officer testified that once the client stopped and he approached,the officer smelled alcohol coming from him,observed bloodshot,glassy eyes and slurred speech,noticed he was unsteady on his feet while trying to get off his motorcycle and when asked, he admitted drinking a few beers. The officer further stated the client failed the walk and turn and one leg stand field sobriety tests. – NOT GUILTY

Plymouth District Court– The first officer testified that after watching him cross the white fog line and double yellow lines several times he stopped the client. The officer stated there was a strong odor of alcohol coming from the car, the client could not find his registration at first,had bloodshot eyes,slurred speech and admitted drinking a couple beers. The officer testified the client was unsteady on his feet. A second officer testified the client could not say the alphabet or count backwards as instructed and could not complete the one leg stand or walk and turn field sobriety tests. – NOT GUILTY

 

April 2015

Brookline District Court– The officer testified he stopped the client for driving in the wrong direction and stated the client continued to drive this way for a half a mile before being stopped.The officer stated the client had bloodshot and glassy eyes,there was a moderate odor of alcohol coming from the car and he admitted drinking. The officer stated the client did not say the alphabet as instructed and did not successfully complete the one leg stand or walk and turn field sobriety tests. – NOT GUILTY

Hingham District Court– The officer testified that client entered a checkpoint and after being sent for further screening,the officer stated the client admitted having a few beers, had red and glassy eyes,slurred speech and there was an odor of alcohol coming from the vehicle. The officer testified that the client was unsteady on his feet while exiting his vehicle and failed the walk and turn and one leg stand field sobriety tests. – NOT GUILTY

 

March 2015

Newton District Court– The officer stated that upon arriving at the report of a motor vehicle collision, he met with the alleged victim who indicated the client had struck her car. The officer reported that while speaking with the client,he smelled a strong odor of alcohol on her breath,noticed she had glassy eyes and rushed,slurred speech,and when asked, the client admitted having a “little cold beverage.” The officer stated the client left her car on after being asked to turn it off, was unsteady on her feet as she walked to the side walk and failed the walk and turn and one leg stand field sobriety test. – CASE DISMISSED

 

February 2015

Quincy District Court– The officer testified that after arriving to the scene of an accident, he saw the client's car turned upside down in the middle of the road with deployed air bags and spoke with the client who smelled like alcohol and admitted driving.The officer stated the client failed the walk and turn and one leg stand field sobriety tests and could not count backwards or say the alphabet as instructed. – NOT GUILTY
